General Terms and Conditions
Article 1
The General Terms and Conditions are the legal basis for defining the rights and obligations arising from transactions with the Koželj gift card. By purchasing or using the Koželj gift card, each buyer and holder of the Koželj gift card undertakes to use the Koželj gift card in accordance with these or the current general terms and conditions, if these change after the purchase of the gift card.
Issuance of the card
Article 2
The issuer and owner of the Koželj gift card (hereinafter: gift card) is Koželj d.o.o., Moste 54, 1218 Komenda (hereinafter: issuer).
Article 3
The following terms are used in these general terms and conditions:
- “gift card buyer” - is a consumer who loads a gift card with credit for the first time
- “buyer” - is a gift card holder who uses a gift card as a means of payment when acquiring goods and services;
- “holder” - is the current owner of a gift card or a person who directly physically disposes of the gift card at a given moment;
- “use of a gift card” - is the payment for goods and services with a gift card that has an available credit balance;
- “gift card” - in accordance with these general terms and conditions, a gift or value card is meant that the issuer issues to the gift card buyer against payment and undertakes to accept it in accordance with these general terms and conditions as a means of payment for goods sold at its points of sale in Slovenia;
- “purchase of a gift card” - is the first loading of a gift card with credit.
Article 4
The purchase of a gift card is possible with any valid means of payment used in the Koželj sales network in Slovenia. The purchase of a gift card is not possible in instalments. When purchasing a gift card, other discounts or promotions are not taken into account. You can purchase a gift card at all points of sale listed in Article 8 of these general terms and conditions.
Article 5
The maximum amount of credit on the card is 1,000 euros, and the minimum amount is 20 euros. The gift card is topped up with credit when purchasing the gift card. Cash withdrawal of the credit on the card is not possible.
Article 6
The validity of the gift card is 1 year from the date of purchase. After the expiration date, any remaining balance on the gift card will no longer be available. The buyer or holder of the gift card is responsible for keeping track of its validity. The holder can check the balance on the gift card at any time at the cash register at the point of sale. The issuer is responsible for handling complaints regarding expired gift cards. Complaints can be submitted to the issuer in writing or via email at: info@kozelj.si.
Use of the Card, Loss, Damage, and Termination of Usage Rights
Article 7
The gift card is NOT issued to a specific name and is transferable, meaning it serves as a bearer payment instrument. The holder of the gift card is considered the rightful user, and the issuer is not obligated to verify the identity of the cardholder when the gift card is used. The issuer does not provide a card-blocking service upon request by the buyer or cardholder. The holder may use the gift card for single or multiple purchases of goods, up to the amount of the available balance on the card. The gift card is valid only in Slovenia at all issuer's sales locations listed in the following article.
Article 8
The purchase and use of the gift card are possible at four Koželj sales locations in Slovenia, specifically:• Koželj Wines Moste, Moste 54, 1218 Komenda
• Koželj Wines Ljubljana, Pogačarjev trg 2, 1000 Ljubljana
• Koželj Wines Brezovica, Tržaška cesta 547a, 1351 Brezovica pri Ljubljani
• Koželj Wines Portorož, Cesta solinarjev 6, 6230 Portorož
The gift card can be used in accordance with its intended purpose. It is available with six pre-printed designs.
If you wish to use the gift card online, please notify us at info@kozelj.si, and we will send you a promotional code for use on www.kozelj.si. In this case, the gift card must be used in full in a single transaction.
Article 9
Upon purchase, the buyer receives a proof of card activation, which they can retain for their records as evidence of the gift card's validity in accordance with Article 6 of these general terms and conditions.
Article 10
Purchases with the gift card can only be made up to the balance available on the card. Installment payments using the gift card are not possible. If the balance on the gift card is insufficient to cover the full purchase amount, the difference can be paid using any valid payment method accepted at Koželj locations.
Article 11
The issuer is responsible for resolving complaints related to payments made with the gift card. Any disputed amounts during the purchase or the loading of the gift card must be submitted in writing by the buyer or cardholder no later than 8 days after the purchase.
Article 12
The issuer of the gift card is not responsible for the loss or theft of the gift card or any potential damage resulting from unauthorized use of the gift card and unauthorized depletion of the credit on the gift card. Lost or stolen gift cards will not be replaced.
In the event of damage or malfunction of the gift card that is not caused by improper handling, the cardholder must send the card along with their personal information by registered mail to the following address: Koželj d.o.o., Moste 54, 1218 Komenda. The issuer will replace the damaged or malfunctioning card free of charge with a new one, loaded with the same balance as the returned card at the time of its receipt by the issuer.
Article 13
These general terms and conditions come into effect on the date of their publication on the issuer’s website www.kozelj.si. The issuer reserves the right to amend the general terms and conditions for the issuance and use of the Koželj gift card without prior notice. The issuer will publish the amended general terms and conditions in visible locations at its points of sale where the gift card can be used for payment and on the website www.kozelj.si.
Article 14
Unauthorized and illegal use of the gift card is punishable. Any disputes between the cardholder and the issuer shall be resolved by the competent court in Ljubljana.
